I was under the impression that the Central Figures of
the Baha'i
Faith and also Shoghi Effendi very much discouraged litigation or even the
attitude of readiness to consider litigation as a solution to problems,
real or perceived.
Even in personal family matters not directly connected
with public
issues or religious questions, 'Abdul-Baha went on record more than once
as being very much against litigation as a problem-solving tool. I have
over the years seen a willingness on the part of Baha'is and Baha'i
institutions to defend themselves with counter-suits after having been
served with legal process.
It would seem to me to be especially inadvisable to
pursue a legal
course for which damages would be almost impossible to ascertain and the
public impact unpredictable. Lawyers have only self-interest at
heart to
recommend the viability of litigation.
At the very least, it seems an unworthy use of precious
time and money
to pursue legal action or even mention the possibility in a forum such as
this. Internet-related litigation is of course a new branch of the legal
profession, but it seems lawyers are pursuing these new possibilities with
an excess of enthusiasm.
By the way, this post by you provides Mr. Glaysher with
grounds for
counter-suit, should he ever be served with legal process by you are anyone
else for the torts you have suggested. Fitness to stand trial is a
particularly low standard of mental competence, requiring only that one be
capable of understanding the nature of one's actions and the nature of the
proceedings. Show your lawyer a copy of your post below and see if you can
squeeze out of that practitioner an "honest" legal opinion as to the
viability of Frederick's case against you.
